Welcome to Budget Application ("the App"), developed and operated by CloudMobile ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application and services.
By downloading, installing, or using the Budget Application, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By creating an account or using the Budget Application, you confirm that:
- You have read, understood, and agree to be bound by these Terms
- You have the legal capacity to enter into a binding agreement
- You will comply with all applicable laws and regulations
- All information you provide is accurate and truthful
2. Service Description
Budget Application is a personal finance management tool that allows users to:
- Track income and expenses
- Create and manage budgets
- Categorize transactions
- Generate financial reports and insights
- Set financial goals and alerts
- Sync data across multiple devices via cloud storage
3. User Accounts
3.1 Account Registration
To use Budget Application, you must:
- Create an account using a valid email address and password, or
- Sign in using your Google account
- Provide accurate and complete registration information
- Maintain the security of your account credentials
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your account information remains current and accurate
3.3 Account Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- Your account remains inactive for an extended period
- We are required to do so by law
4. Subscription and Payment Terms
4.1 Free Trial
New users receive a 30-day free trial of premium features. At the end of the trial period, you will automatically be downgraded to the free version unless you purchase a subscription.
4.2 Subscription Plans
We offer the following subscription options:
- Monthly Subscription: Billed monthly with automatic renewal
- Annual Subscription: Billed annually with automatic renewal
- Lifetime Purchase: One-time payment for permanent access
4.3 Premium Features
Premium subscribers receive:
- Ad-free experience (no banner ads or video ads)
- Unlimited budget categories
- Advanced reporting and analytics
- Priority customer support
- Cloud backup and sync
- Additional customization options
4.4 Payment Processing
All payments are processed securely through Google Play Store. Prices are displayed in your local currency and may vary by region. Applicable taxes will be added at checkout.
4.5 Automatic Renewal
Monthly and annual subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Google Play Store account settings.
4.6 Refund Policy
All purchases are subject to Google Play Store's refund policy. Generally, refunds are available within 48 hours of purchase. Lifetime purchases are non-refundable after 48 hours. Contact us at support@cloudmobile.co.za for refund requests.
5. Advertising
5.1 Free Version Advertising
The free version of Budget Application displays advertisements, including:
- Banner Ads: Displayed throughout the app interface
- Video Ads: Mandatory video advertisements shown when adding transactions
5.2 Ad Networks
Advertisements are served through Google AdMob. These ads may be personalized based on your interests and activity. Ad networks may collect data as described in our Privacy Policy.
5.3 Ad-Free Experience
Premium subscribers enjoy a completely ad-free experience with no banner ads or video interruptions.
6. Data Storage and Privacy
6.1 Data Collection
We collect and process:
- Account information (email, name, authentication data)
- Financial data you enter (transactions, budgets, categories)
- Device information (device type, operating system, unique identifiers)
- Usage data (app interactions, features used, crash reports)
- Information from third-party services (Google Sign-In, AdMob)
6.2 Data Storage
Your data is stored:
- Locally: On your device for offline access and quick performance
- Cloud Storage: On secure Firebase servers for backup and cross-device synchronization
6.3 Data Security
We implement industry-standard security measures to protect your data, including:
- Encryption in transit and at rest
- Secure authentication protocols
- Regular security audits and updates
- Restricted access to personal data
Important: While we take reasonable measures to protect your data, no method of transmission over the internet or electronic storage is 100% secure. You use the App at your own risk.
6.4 Data Retention
We retain your data for as long as your account is active or as needed to provide services. If you delete your account, your data will be permanently deleted within 90 days, except where retention is required by law.
7. User Responsibilities
You agree to:
- Use the App only for lawful purposes
- Provide accurate financial information
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App to store or transmit malicious code
- Not interfere with or disrupt the App's functionality
- Not attempt to gain unauthorized access to our systems
- Not use automated tools to access the App without permission
- Comply with all applicable laws and regulations
8. Intellectual Property Rights
8.1 Our Rights
Budget Application, including all content, features, functionality, software code, designs, graphics, and trademarks, is owned by CloudMobile and protected by international copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
8.3 Your Content
You retain ownership of all financial data and content you enter into the App. By using the App, you grant us a license to process, store, and display your content solely for providing our services.
9. Third-Party Services
Budget Application integrates with third-party services:
- Google Play Services: For authentication, payments, and app distribution
- Firebase: For cloud storage, authentication, and analytics
- Google AdMob: For advertising in the free version
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.
10. Disclaimers and Limitations
10.1 Financial Advice Disclaimer
Important: Budget Application is a financial tracking tool only. We do not provide financial, investment, tax, or legal advice. The App's calculations, reports, and suggestions are for informational purposes only and should not be considered professional financial advice. Consult qualified professionals for financial planning decisions.
10.2 Accuracy of Information
While we strive for accuracy, we do not guarantee that:
- The App will be error-free or uninterrupted
- All calculations will be completely accurate
- The App will meet your specific requirements
- Data synchronization will always be immediate or complete
10.3 Service Availability
We reserve the right to:
- Modify, suspend, or discontinue any part of the App
- Perform scheduled maintenance with or without notice
- Limit features or access to certain users or regions
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
CloudMobile, its directors, employees, partners, and affiliates SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Loss of data or information
- Financial losses resulting from inaccurate calculations
- Business interruption
- Loss of goodwill or reputation
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless CloudMobile and its officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or transmit through the App
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
- We will update the "Last Updated" date at the top of this page
- Significant changes will be communicated via email or in-app notification
- Continued use of the App after changes constitutes acceptance
- If you disagree with changes, you must stop using the App
14. Geographic Restrictions and International Use
Budget Application is available worldwide. However:
- Features and pricing may vary by region
- Some features may not be available in all countries
- You are responsible for compliance with local laws
- Currency conversion rates are approximate and may vary
- We may restrict access in certain jurisdictions
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law provisions.
15.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Good faith negotiations between the parties
- Mediation, if negotiations fail
- Binding arbitration in Johannesburg, South Africa, if mediation fails
15.3 Class Action Waiver
You agree that any proceedings will be conducted only on an individual basis and not as a class action, consolidated action, or representative action.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CloudMobile regarding the use of Budget Application and supersede all prior agreements and understandings.
